ISTA legal counsel files more than 100 appeals on behalf of local associations

ISTA_Building.jpgIn response to hundreds of compliance reports for 2015-16 collective bargaining agreements by the Indiana Education Employment Relations Board (IEERB), ISTA legal counsel Eric Hylton has filed 114 appeals today on behalf of local associations.

 

IEERB issues compliance reports after evaluating whether a collective bargaining agreement between a local association and its school board is compliant with state laws that regulate what can and cannot be in the agreements.

 

Hylton has also filed a lawsuit against IEERB stating that the board overreached their authority to review compensation models and to issue general comments, rather than reviewing whether contracts are strictly compliant or non-compliant.

 

Hylton and ISTA staff worked under an intense 15-day deadline to review every compliance report and draft responses. This is the result of legislators not allowing local associations and superintendents to work together on a contract without IEERB, whose members are appointed by the governor, inserting themselves into the process. All contracts IEERB found to be non-compliant were all mutually agreed to and signed by both the associations and school board representatives.
